Advia Credit Union’s Holiday $3K Giveaway Official Rules

BY ENTERING OR OTHERWISE PARTICIPATING IN THE SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY. WITHOUT LIMITATION, THIS CONTRACT REQUIRES YOU TO INDEMNIFY AND RELEASE ALL CLAIMS AGAINST THE SWEEPSTAKES ENTITIES (AS DEFINED BELOW) AND TO AGREE TO ARBITRATION WITH NO CLASS RELIEF AND A LIMITATION OF YOUR RIGHTS AND REMEDIES. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION WITH NO CLASS RELIEF.

 NO PURCHASE, PAYMENT OR TRANSACTIONS OF ANY KIND NECESSARY TO ENTER OR WIN. NON-PURCHASE ENTRIES AND PURCHASE ENTRIES HAVE AN EQUAL CHANCE OF WINNING.  SWEEPSTAKES OPEN ONLY TO ADVIA CREDIT UNION MEMBERS IN GOOD STANDING WHO ARE LEGAL RESIDENTS OF THE STATES OF IL, MI AND WI, 18 YEARS OF AGE OR OLDER AS OF OCTOBER 1, 2023.

ELIGIBILITY: Sweepstakes is open only to Advia Credit Union members in good standing who are legal residents of the States of Illinois, Michigan and Wisconsin, who must have either a Social Security Number or Tax Identification Number and are 18 years of age or older as of OCTOBER 1, 2023 (“Eligible Participants”). Employees and volunteers of Advia Credit Union (“Sponsor” or “Advia CU”), JXM advertising agency, their respective subsidiaries, advertising/promotion agencies, each of their respective officers, directors, and agents (collectively, the “Sweepstakes Entities”) and their immediate  families (spouse, parents, IRS dependents, children and siblings and their respective spouses) and/or those living in the same household of such employees, whether related or not, are not eligible to participate. Sponsor reserves the right to verify eligibility qualifications of the prize winner. Sweepstakes is subject to all applicable, federal, state, local laws and regulations. Void in all other States of the United States and U.S. Territories and wherever else prohibited by law. 

DESCRIPTION & SWEEPSTAKES TIMING: Advia Credit Union’s Visa® $3K Holiday Giveaway (“Giveaway” or “Sweepstakes”) begins at 12:00 AM Eastern Time (“ET”) on October 1, 2023, and ends at 11:59:59 PM ET on December 31, 2023 (the “Sweepstakes Entry Period”). The Sponsor’s computer will be the official timekeeping device for this Sweepstakes. 

HOW TO ENTER:  There are two (2) ways to enter the Sweepstakes: 

Purchase Entry Method: An Advia CU member will receive one (1) automatic Sweepstakes entry, up to a maximum of three (3) entries each week, when they make an eligible purchase at any verified merchant with a valid Advia Credit Union Visa® Debit Card or Visa® Advantage Points or Fixed Rate Credit Card during the promotional period of October 1, 2023 – December 31, 2023.

There will be two specific days where an Entry Multiplier will be offered (Friday, November 24, 2023, and Monday, November 27, 2023), where each qualifying purchase made only on those specific days will count as two (2) entries. In all cases, including those weeks in which double entries are provided, qualifying entries will be limited to three (3) per week. Entries from unauthorized card use or purchases made on cards that are made with lost, stolen, or fraudulent credit or debit cards are void. A purchase, payment or transaction will not improve the chances of winning the prize. 

To enter without purchase or obligation: To receive one (1) Sweepstakes entry each time a valid alternate entry is submitted, up to a maximum of three (3) entries each week, an Advia CU member may send in a mail-in entry on a 3“x 5” piece of paper and handwrite their full name, street address, city, state, ZIP code (no PO Boxes allowed), daytime phone number and e-mail address and the location of the Advia CU that you most often visit, and mail it, in a #10 size envelope that must have your full name and complete mailing address that is legibly hand written in upper left hand corner on the outside of the envelope with only an affixed postage stamp that can be used to pay for postage fee (using a metered postage machine will not be accepted as a form of payment for postage and entry would be disqualified), to: Advia CU Visa® $3K Holiday Giveaway, c/o Marden Kane Inc., PO Box 698, Syosset, NY 11791-0698. Mail-in entries are limited to no more than three (3) per week. Each mail-in entry must be sent in a separate envelope and be postmarked by January 2, 2024, and received no later than January 6, 2024, to be eligible for the random drawing.

To receive additional entries without making a purchase during the Entry Multiplier days on November 24, 2023, and November 27, 2023, as noted above, hand write the words “ENTRY MULTIPLIER OF 2X” in the bottom left-hand corner of the envelope. Your mail-in entry must have a postmark date of November 24, 2023, and/or November 27, 2023 and must be received within 5 days (deadlines of November 29, 2023 and December 2, 2023, respectively) to be eligible to receive double entries. If mail-in entries are not received by November 29, 2023, and December 2, 2023, and do not include the handwritten words “ENTRY MULTIPLIER OF 2X” in the left-hand corner of the envelope, entrant will only receive one (1) Sweepstakes entry.

All mail-in entries received become the sole property of the Sponsor and will not be acknowledged or returned. Sponsor is not responsible for late, lost, incomplete, illegible, incorrect, damaged, postage due or misdirected entries, all of which will be disqualified. Entries received in excess of the allowable limit noted above will be void. 

Proof of mailing alternate entry does not constitute proof of actual receipt/delivery of an Entry for purposes of this Sweepstakes. Please be advised that you are only entering Advia Credit Union’s Visa® $3K Holiday Giveaway and will NOT receive an entry into any other Sweepstakes at this time. By participating in the Sweepstakes through the use of your valid Visa® Debit Card or Visa® Advantage Points or Fixed Rate Credit Card to make a verified purchase and/or your submission of an alternate method of entry, all entrants agree to be bound by these Official Rules, which are final and binding on all matters pertaining to this Sweepstakes.  Sweepstakes entries are limited to no more than a combination of three (3) per week regardless of entry method used.  

PRIVACY & PERSONAL INFORMATION: At the time of Sweepstakes entry, entrants will have the opportunity to opt-in to receive further communications from the Sponsor. Entrants are not required to opt-in to participate in this Sweepstakes and opting in will not increase your chances of winning. If an Entrant chooses to opt-in, the Entrant thereby grants the Sponsor permission to send him/her future communications regarding services, incentives, offers, promotions, or other messaging related to the Sponsor’s services and products. RANDOM DRAWING DETAILS: A random drawing will be conducted by Marden Kane, Inc., an independent judging organization, on or about January 16, 2024 from all eligible entries received. Winner will be contacted on or about January 19, 2024. Odds of winning will depend on the total number of eligible Entries received during the Sweepstakes Entry Period. Decisions of the Sponsor will be final and binding on all matters relating to the random drawing and all other matters regarding this Sweepstakes. Grand Prize will be awarded provided a sufficient number of eligible Entries are received by the Sweepstakes Entry Period deadline date in order to conduct the random drawing. Prize is nontransferable and no substitutions are allowed except by Advia CU who reserves the right to award a prize of equal or greater approximate retail value and comparable use. Potential winner is subject to verification of eligibility and compliance with these Official Rules.

PRIZE: One (1) Grand Prize: $3,000 awarded in the form of one-time (1) deposit into Advia CU Share Savings Account within approximately two (2) weeks after prize confirmation and verification has been completed.

Winner must have each of their accounts in good standing in accordance with the terms described in the Advia CU Account Disclosures and Agreements posted at: https://www.adviacu.org/docs/default-source/disclosures/advia-member-agreement-tis.pdf or else their entry would be disqualified, and an alternate winner would be selected in accordance with these Official Rules. The winner shall bear all risk of loss to their prize after being awarded it by Advia CU who is not responsible for it being lost, stolen or withdrawn from their Advia CU Share Savings Account without permission; nor will the prize be replaced. Any and all other costs and expenses associated with prize acceptance and use not specifically stated within these Official Rules as being provided, are the sole responsibility of the winner, including, without limitation, all federal, state, and local taxes. If due to a printing, production, technical, human, or other type of error, more than one (1) Grand Prize is claimed than is to be awarded, the intended prize will be awarded in a random drawing from among all verified and validated prize claims received for the Grand Prize. In no event will more than one (1) Grand Prize be awarded.

WINNER NOTIFICATION AND VERIFICATION: Potential Grand Prize Winner will be required to complete and return an Affidavit of Eligibility/Liability/Publicity/Release Form (“Affidavit”) before being awarded the prize which must be returned within ten (10) days of attempted notification. As required by law, the Grand Prize winner, who will be awarded a prize valued at $600 or more, will also be required to report their prize to the IRS and complete the W9 Form with their social security number. Prize award is subject to verification of potential Prize winner’s identity and eligibility to Sponsor’s satisfaction. In the event that potential winner cannot be contacted, fails to return the Affidavit within the required timeframe noted above, refuses the prize, or is disqualified for any reason, Sponsor will select an alternate potential winner in a random drawing from among all remaining eligible entries, if time permitting, up to four (4) alternates. If each of the alternate potential winners are disqualified, the prize will not be awarded. No compensation will be given upon prize forfeiture. 

GENERAL CONDITIONS: All materials submitted become the sole property of Advia CU and will not be returned. The Affidavit is subject to verification by Advia CU. The awarding of the prize is contingent on individual’s full compliance with these Official Rules, as determined by Advia CU in its sole discretion. Sponsor reserves the right not to award the stated prize if, in its’ sole discretion, it determines that it does not have a sufficient number of qualified entries. Acceptance of prize constitutes permission of the winner to allow Advia CU and its agencies the right to use winner’s name, city, state, prize information, biographical information, comments, voice, image, photograph, and/or likeness for purposes of advertising, trade and/or publicity without further compensation in all media now known or hereafter discovered, in perpetuity, worldwide and on the World Wide Web, without notice, review or approval, unless prohibited by law. If winner is found to have falsified any data or material, the winner forfeits his/her prize and is disqualified, and an alternate winner will be selected according to the original winner selection method. In the event there is a discrepancy or inconsistency between disclosures, or other statements contained in any Sweepstakes or advertising materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.

Multiple entrants are not permitted to share the same email address. In the event of a dispute over the identity of the potential winner, the entry will be declared made by the authorized account holder of the email address submitted at the time of entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such email address. The authorized account holder is deemed as the natural person assigned to an email address by an Internet access provider, service provider, or other organization responsible for assigning email addresses or the domain associated with the submitted email address. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her email address after the Sweepstakes Entry Period has ended. All entries become the property of Sponsor and will not be returned to entrant. By participating in the Sweepstakes, all Entrants agree to indemnify, release and hold harmless employees and volunteers of Sponsor, JXM advertising agency and their respective parent, subsidiaries and all of their respective employees, directors, officers, agents, successors and assigns, (collectively “Releasees”), from any injuries, losses, damages, claims and actions of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, non-use or misuse of a prize. Advia CU and its agents, as defined above as part of Releasees, shall not be responsible for printing, typographical or other inadvertent errors in any Sweepstakes-related materials or other errors relating to or in connection with the Sweepstakes, including without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of winner; or winner’s paperwork to be processed that is lost, misdirected, delayed, undecipherable, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly for any reason, including any equipment, systems, networks, lines, satellites, servers, computer, telephone, paper transfer, or human error or electronic, computer, or telephonic malfunction or error. Sponsor is not required to enter into correspondence with entrants, including via e-mail. Sponsor and all other Released Parties (as defined above) have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any part of the Prize, including, without limitation, as to such Prize’s quality or fitness for a particular purpose.  

CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL & CIVIL LAWS & SHOULD SUCH AN ATTEMPT BE MADE, ADVIA CREDIT UNION RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Advia CU’s failure to enforce any terms of these Official Rules shall not constitute a waiver of that or any other provision. Each entry must be manually key stroked and manually entered by the individual entrant. Any automated and/or electronic submission of entry (including but not limited to entries made using any script, macro, bot, or Sweepstakes service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. If, in Advia CU’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, Advia CU reserves the right at their sole discretion, to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prizes among all valid entries received as of the termination date. The Sponsor will not be responsible for acts of God, dangerous weather conditions, pandemic virus, acts of terrorism, civil disturbances, work stoppage or any other matters beyond the Sponsor's reasonable control (each a “Force Majeure” event) that may cause the cancellation or postponement of the Sweepstakes. In the event of termination of the Sweepstakes, a notice will be publicized by Sponsor and a drawing to award the Prize will be conducted from among all eligible entries received prior to termination.  

In the event of any discrepancy between the privacy policy and these Official Rules, the privacy policy shall control and govern. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States and the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

Except where prohibited, as a condition of participating in this Sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the participant and any Releasee, claims and causes of action arising out of or connected with this Sweepstakes, or the prize awarded, or the determination of the winner must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will a participant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (if any), and participant further waives all rights to have damages multiplied or increased.
